Estate Law deals with the creation of Wills, Trusts, Guardianships, Powers of Attorney, Designation of Health Care Surrogates and other legal documents that serve as Estate Planning tools. A well thought-out estate plan can help a family avoid the time and expense of having to probate their loved-one’s property after his or her death.
Estate Law also encompasses the legal aspects of moving assets from the deceased to his or her heirs. If an estate plan is in place, then this is a process called Estate Administration. If estate planning has not been done, then the estate may have to be probated, a legal process to establish the heirs and a to determine a fair division of property.
